Yahoo! Volvo C30 Competition Promotion Terms and Conditions

  1. This promotion is run by Volvo Car UK Limited (company number 2281044), Globe Park, Marlow, Buckinghamshire, SL7 1YQ ("Volvo"), in association with Vice Magazine Publishing Inc. (“VICE”), Independent News and Media Limited (“INM”), and Yahoo! UK Limited (“Yahoo!”). Volvo is the sole promoter, and whilst VICE, INM and Yahoo! collaborate with Volvo on this promotion, neither of those collaborators share rights or responsibilities in running the promotion, either collectively or individually.

  2. By entering this promotion you agree to these terms and conditions which will at that time become binding between you and Volvo. Your participation in the promotion is in consideration for Volvo allowing you to enter it and giving you the opportunity to win.

  3. No purchase is necessary in order to enter the promotion. There is no fee charged to enter into this promotion other than the cost of you accessing the Internet which you would otherwise have.

  4. You must be over 18 and a resident of the United Kingdom to enter into this promotion and receive the relevant prize if you win. Employees and/or family members of Volvo, VICE, INM or Yahoo! or any dealers or agencies associated with this promotion are not eligible to enter or participate. Entrants will be deemed be the natural person to whom the email address (provided on entry) is registered. Only one entry per person is permitted.

  5. To be eligible, you must submit your piece(s) of creative as detailed on the prize entry submission page at creative30.net. Entries must be received no later than 2400 hours (UK time) on 28 September 2008 (or such later closing date as may be notified to entrants on the promotional pages) at which time entry to this promotion will close. An independent panel of judges (the ³Panel²), appointed by Volvo together with VICE, shall select up to 15 submitted entries which shall go through to the final stage of the promotion along with 15 pre-selected entries also chosen by the Panel prior to the start date of the promotion. From the final stage entries, two winners shall be selected, one to be selected by public vote and one to be selected by the Panel. The entrant whose piece of creative receives the highest number of public votes on creative30.net will win the People¹s Prize as detailed below. The entrant whose piece of creative is selected as the winner by the Panel shall win the Panel Prize as detailed below. The winner of the People¹s Prize is not applicable to win the Panel Prize (and vice versa).

  6. By entering into this promotion, you agree and acknowledge that:

  7. The People’s Prize for the competition is a Volvo C30 1.6 R-Design Sport (OTR price £14,995 at the time of this promotion) and the vehicle must be registered in the UK. Any pictures used to promote the People’s Prize are for information only. The winner of the People’s Prize will be able to specify the external colour of the vehicle, subject to availability. The winner of the People’s Prize may also be able to upgrade the specification of the vehicle through accessories and options at their own cost, subject to availability. The winner of the People’s Prize will be responsible for making their own arrangements for the taxation, insurance and maintenance of the vehicle. There is no cash alternative to the People’s Prize.

  8. The Panel Prize is a separate cash prize of £10,000 awarded to a Creative 30 entrant by the Panel. The Panel's decision is final and cannot be appealed and no correspondence will be entered into.

  9. The winners will be contacted by email and/or telephone (on the email address and telephone number(s) given with entry details) by Volvo within 10 days of the closing date of the promotion.

  10. Every reasonable effort will be made to reach the winners. If the winner of the People’s Prize cannot be contacted or if arrangements cannot be made to deliver the prize to that winner within six months of the closing date of the promotion, the People’s Prize will revert to Volvo and may be awarded to another entrant at Volvo’s absolute discretion. If the winner of the Panel Prize cannot be contacted or if arrangements cannot be made to deliver the prize to that winner within six months of the closing date of the promotion, the Panel Prize will revert to Volvo and may be awarded to another entrant at Volvo’s and the Panel’s absolute discretion.

  11. Volvo will deliver the People’s Prize and the Panel Prize to the respective winners as soon as reasonably practicable following winner selection and notification, subject to section 10 above.

  12. Your personal information may be used by Volvo and VICE to conduct the promotion and for participation in the prize, in accordance with Volvo’s Privacy Policy, currently located at www.volvocars.co.uk/privacypolicy. If you are a winner or a finalist, Volvo and VICE may use the personal information you have submitted during the promotion for marketing or promotional purposes, including using your name and likeness to publish winner and finalist details.

  13. You agree to the processing by Volvo, VICE and their affiliates of personal information about you submitted when you enter this promotion or collected if you participate in a prize (including without limitation information about your physical or mental health, racial or ethnic origins, religious or similar beliefs, sexual life, political opinions, trade union membership, criminal convictions or alleged criminal activity, as applicable), for the purposes and in the manner set out above or in the Volvo Privacy Policy (including the disclosures of such information or transfer of it to jurisdictions which may not provide the same legal protection as in the United Kingdom or the country in which you are located).

  14. Except as otherwise required by applicable law, neither Volvo, VICE, INM nor Yahoo! are responsible for any loss or damage associated with you entering into this promotion, the finalist and winner selection process or the provision or otherwise of any aspect of any prize or any act or omission of any other person or party, and all warranties, conditions and representations (of any kind) not expressly set out in these terms and conditions are hereby excluded.

  15. Volvo may terminate these terms and conditions, the promotion or any prize if you do not comply with any of these terms and conditions or are unlikely to do so, if Volvo decides in its absolute discretion to withdraw the promotion before any winners are notified, or thereafter if any circumstances beyond Volvo’s reasonable control prevent or restrict Volvo or any other person or party from providing the prize or any aspect of the prize.

  16. You agree that (unless applicable law requires otherwise) any right that you have under applicable law to cancel ends when winners of the promotion are announced. If thereafter you cannot participate in any prize for reasons beyond your reasonable control, you must notify Volvo and Volvo may in its absolute discretion allocate that prize to someone else.

  17. You may not assign or transfer your rights or obligations, or subcontract your obligations, under these terms and conditions, such as transferring the right to a prize to anyone else, without Volvo’s prior written consent. Volvo may assign or transfer its rights or obligations, or subcontract its obligations, under these terms and conditions without your consent.

  18. Volvo retains and reserves (a) all rights in and to the creative30.net site, and all aspects of the prize draw and each prize, including all derivatives, developments, modifications and improvements; and (b) the right to use the whole or any part of all piece(s) of creative that may be submitted by entrants for marketing and/or promotional purposes.

  19. These terms and conditions, and any instructions from Volvo, constitute the entire agreement between you and Volvo, superseding any prior agreements between you and Volvo. Any failure or delay by Volvo, in exercising or enforcing, or partial exercise or enforcement of, any right or provision of these terms and conditions shall not constitute a waiver of such right or provision (or waive any further exercise or enforcement) or any other right or provision. If any provision of these terms and conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision and the other provisions of the terms and conditions will remain in full force and effect.

  20. These terms and conditions and all matters arising from or in connection with them are governed by English law and the courts of England will have exclusive jurisdiction in the event of any such dispute.
